Acceptance and eligibility

These Terms of Use govern your access to and use of 100clubnwa.org (the “Website”), operated by The 100 Club of Northwest Arkansas, also known as The 100 Club or The 100 Club of NWA (“we,” “us,” or “our”). By accessing or using the Website, you accept these Terms. If you do not agree, do not use the Website. You must be at least 18 years old to use the Website, register, submit information, or make payments. If acting for a business or another organization, you represent that you have authority to act for it.

Our organization and Website

The 100 Club of Northwest Arkansas is an Arkansas nonprofit organization described in Section 501(c)(3) of the Internal Revenue Code. The Website provides information about our charitable activities and may offer donations, registrations, memberships, orders, and related services. Website access or a donation does not establish eligibility for financial assistance or guarantee assistance to any person. Any assistance is subject to the applicable program criteria and our lawful charitable decision-making.

Privacy and accurate information

Our Privacy Policy explains how we handle information collected through the Website. Read it before submitting personal or payment information. These Terms do not replace any consent required by privacy law. You must provide accurate information, submit only information you are authorized to provide, and keep registration details current. If accounts are offered, protect your login credentials and promptly report suspected unauthorized use by email to donors@100ClubNWA.org.

Permitted use

You may use the Website for lawful informational purposes and legitimate transactions with us. Do not impersonate others; submit fraudulent donations or unauthorized payments; infringe intellectual property or privacy rights; upload harmful code; attempt unauthorized access; interfere with security or Website operations; or use automated tools in a way that disrupts the Website or unlawfully collects personal information. We may restrict access or remove submissions when reasonably necessary to address violations, fraud, security risks, or legal requirements.

Donations and use of funds

By submitting a donation, you authorize the charge shown at checkout and represent that you are authorized to use the payment method. Review the amount and other transaction details before submitting. A donation is not an investment and provides no ownership interest or financial return.

Unless we expressly accept a restriction in writing or state a specific restriction in the applicable campaign, donations support our charitable purposes and may be applied to program, administrative, and fundraising expenses at our discretion. A message accompanying a donation does not by itself create an accepted restriction. We will administer accepted restricted gifts consistently with applicable law and the accepted restriction.

If recurring donations are offered and you expressly select that option, you authorize charges at the amount and interval disclosed when you enroll. You may cancel future charges through any cancellation method supplied with enrollment or by email to donors@100ClubNWA.org. Cancellation applies to future charges that can reasonably be stopped after receipt and does not automatically reverse completed donations.

Errors refunds and other transactions

Contact us promptly by email to donors@100ClubNWA.org about duplicate, mistaken, or unauthorized charges. We will review requests and make corrections or refunds as required by law and as otherwise appropriate to the circumstances. Do not include full payment card or bank account details in the request. These Terms do not limit rights you may have under applicable law or your payment provider’s rules.

For merchandise, registrations, events, or other purchases, review the description, price, delivery terms, cancellation terms, and refund terms displayed before checkout. Specific terms disclosed for that transaction govern its subject matter if they conflict with these general Terms. We will not substitute a different refund policy for one disclosed and accepted at checkout.

Tax treatment and acknowledgments

Donations may be deductible for United States federal income tax purposes to the extent permitted by law. Deductibility depends on the contribution, any goods or services received, and your circumstances. Purchases, event fees, and membership payments are not necessarily fully deductible. We do not provide individual tax advice or guarantee a deduction.

We provide donation acknowledgments and disclosures as required by applicable law. A donor claiming a deduction for a single contribution of $250 or more generally needs a contemporaneous written acknowledgment stating the amount of cash contributed or describing noncash property, and whether goods or services were provided in return, including the required description and good-faith value estimate when applicable. For a payment exceeding $75 that is partly a contribution and partly payment for goods or services, we provide the required written disclosure of the deductible limitation and a good-faith estimate of the value received, subject to applicable exceptions. A Website policy is not a substitute for your transaction-specific acknowledgment.

Donor names and logo permission

We may display personal donor names and business names in the Website donor list as described in our Privacy Policy. Contact us before donating if you want your name omitted, or afterward to request removal by email to donors@100ClubNWA.org..

By submitting a logo for donor recognition, you grant us a nonexclusive, royalty-free license to reproduce, resize, and display it on 100clubnwa.org for donor recognition. You represent that you own the logo or have permission to authorize this use. You retain ownership. Contact us by email to donors@100ClubNWA.org to request an end to future Website display. We may retain transaction and permission records as required by law. Donor recognition does not imply that we endorse the donor’s products or services, or that the donor endorses every statement on the Website.

Website content and external services

Except for donor materials and other content owned by third parties, Website text, graphics, logo(s), branding, and other materials are owned by us or our licensors and protected by applicable law. You may view and print reasonable portions for personal, noncommercial informational use while preserving ownership notices. Other uses require permission unless authorized by law.

Links and third-party payment or other services may be subject to separate terms and policies. We do not control third-party services or guarantee their content, availability, or security. A link does not by itself imply endorsement.

Availability and disclaimers

To the extent permitted by law, the Website and its informational content are provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, or noninfringement. We do not guarantee uninterrupted access, error-free content, or that the Website will be free of harmful components. We may correct information or modify Website features. These disclaimers do not override express transaction commitments or warranties that cannot lawfully be excluded.

Limits of liability

To the extent permitted by applicable law, we and our directors, officers, employees, subcontractors and volunteers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of or inability to use the Website. This exclusion does not apply to fraud, willful misconduct, gross negligence, or liability that cannot lawfully be excluded. Nothing in these Terms waives nonwaivable consumer rights or excuses obligations concerning accepted donations, purchases, or personal information.

Governing law and disputes

Arkansas law governs these Terms without regard to its conflict-of-law rules, except to the extent controlling federal law or mandatory law applicable to you provides otherwise. Unless applicable law requires otherwise, disputes concerning these Terms or the Website must be brought in a state court with jurisdiction in Arkansas or a federal court with jurisdiction in Arkansas. Nothing in these Terms prevents you from exercising a nonwaivable right to bring a claim in another forum or contacting a regulator.

Changes and general provisions

We may revise these Terms by posting a new version and updating the effective date. Changes apply prospectively from posting unless a different effective date or procedure is required by law. By continuing to use the Website after changes take effect, you accept the revised Terms to the extent permitted by law. Changes do not retroactively alter completed transactions or accrued claims.

If a provision is unenforceable, the remaining provisions remain effective to the extent permitted by law. Failure to enforce a provision does not waive it. These Terms and any applicable transaction-specific terms constitute the agreement concerning Website use; they do not override a separate written agreement signed by us.
